N\u00eb m\u00ebnyr\u00eb t\u00eb vecant\u00eb gjat\u00eb val\u00ebs apo dekad\u00ebs s\u00eb dyt\u00eb t\u00eb zgjerimit n\u00eb jug t\u00eb Europ\u00ebs ( 1980-1990) me vende si Spanja, Greqia e Portugalia t\u00eb cilat kishin dal\u00eb nga sistemet autokratike , logjika e \u201cluft\u00ebs s\u00eb ftoht\u00eb\u201d u shoq\u00ebrua me \u201c arsyetimin e nxeht\u00eb emocional \u201c brenda vendeve t\u00eb an\u00ebtare t\u00eb BE.<\/p>\n\n\n\n<p>Kjo spikati vecan\u00ebrisht n\u00eb rastin e pranimit t\u00eb Greqis\u00eb, kur opinioni negativ i Komisionit Europian t\u00eb 12 Shtatorit 1975 u kap\u00ebrcye nga \u201carsyetimi\u201d i ministrave t\u00eb jasht\u00ebm se \u201cmosan\u00ebtar\u00ebsimi i Greqis\u00eb kushtonnte m\u00eb shum\u00eb sesa an\u00ebtar\u00ebsimi\u201d . Gjithsesi vet\u00ebm pas p\u00ebrfundimit t\u00eb Luft\u00ebs s\u00eb Ftoht\u00eb dhe trokitjeve t\u00eb para t\u00eb ish- vendeve komuniste t\u00eb Europ\u00ebs Q\u00ebndrore e Lindore n\u00eb der\u00ebn e unionit, BE do t\u00eb p\u00ebrvijonte nj\u00eb \u201c ngrehin\u00eb\u201d t\u00eb t\u00ebr\u00eb ligjore e institucionale q\u00eb do t\u00eb p\u00ebrkufizohej si \u201cpolitika apo metodologjia e zgjerimit \u201c n\u00ebn togfjal\u00ebshin \u201c Kriteret e Kopenhagenit\u201d .<\/p>\n\n\n\n<p>Samiti i Kopenhagenit i mbajtur n\u00eb Qershor 1993, do t\u00eb sh\u00ebnonte fillimin e nj\u00eb \u201cmetodologjie\u201d t\u00eb mir\u00ebfillt\u00eb zgjerimi, ku vendet e Europ\u00ebs Q\u00ebndrore e Lindore do t\u00eb duhej t\u00eb p\u00ebrmbushnin nj\u00eb s\u00ebr\u00eb kriteresh politike e ekonomike, duke kaluar n\u00eb \u201c purgatorin\u201d e negociatave \u201c n\u00eb m\u00ebnyr\u00eb q\u00eb tu hapeshin \u201cdyert e parajs\u00ebs\u201d p\u00ebr n\u00eb BE.<\/p>\n\n\n\n<p>P\u00ebrtej k\u00ebtij krahasimi apo alegorie, n\u00eb fakt politika e metodologjia e zgjerimit t\u00eb BE q\u00eb nga viti 1993 u p\u00ebrcaktua nga cdo vend kandidat si nj\u00eb rrug\u00ebtim linear ku duheshin p\u00ebrmbushur 3 kritere si 1) kriteri politik 2) kriteri ekonomik q\u00eb u njoh\u00ebn si Kriteret e Kopenhaagenit dhe 3)kriteri i kapaciteteve administrative q\u00eb u njoh si Kriteret e Madridit . Termi q\u00eb nisi t\u00eb p\u00ebrdorej gjithnj\u00eb e m\u00eb shpesh dhe q\u00eb do t\u00eb ishte shtylla e metodologjis\u00eb s\u00eb zgjerimit pas vitit 1993 ishte \u2018acqui communitaire\u201d . N\u00eb vetvete ky term nga gjuha fr\u00ebnge ishte i lidhur me dy fjal\u00eb kryesore q\u00eb m\u00ebshironin thelbin e k\u00ebsaj metodologjie zgjerimi : acquis q\u00eb do t\u00eb thot\u00eb \u201c i marr\u00eb nga \u201c dhe communautaire &#8220;i komunitetit&#8221;, pra termi acqui communtaire n\u00ebnkupton\u201c legjislacionin q\u00eb merret nga Komuniteti Europian\u201d. N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, procesi e metodologjia e zgjerimit parashikonte q\u00eb cdo vend kandidat p\u00ebr n\u00eb BE t\u00eb p\u00ebrfshinte dhe t\u00eb p\u00ebrshtaste n\u00eb legjislacionin e vendit t\u00eb tij k\u00ebt\u00eb acquis q\u00eb \u00ebsht\u00eb e ndar\u00eb n\u00eb 35 kapituj.Duke patur parasysh k\u00ebt\u00eb zhvillim, vet\u00eb metodologjia e zgjerimit p\u00ebrcakonte q\u00eb cdo vend kandidat dhe ekipi i tij negociator duhet t\u00eb mbanin nj\u00eb sy nga tavolina e negociatave dhe nj\u00eb sy nga Acqui Communitaire q\u00eb p\u00ebrdit\u00ebsohej rregullisht n\u00eb Fletoren Zyrtare t\u00eb Bashkimit Evropian (OJEU &#8211; The Official Journal of the European Union ), e cila botohet prej vitit 1952 nd\u00ebrkoh\u00eb q\u00eb nga viti 1998 ofrohet p\u00ebrmes sh\u00ebrbimit EUR-Lex. Evoluconi institucional ka d\u00ebshmuar sesi ka l\u00ebvizur r\u00ebnd\u00ebsia e dinamika e k\u00ebtij procesi dhe metodologjia e tij p\u00ebrgjat\u00eb viteve. Nga ky k\u00ebndv\u00ebshtrim v\u00ebrehet se portofoli i Komisionerit Europian p\u00ebr Zgjerimin ( EU Enlargement Commissioner) u krijua vet\u00ebm n\u00eb vitin 1999, pas miratimit t\u00eb Traktatit t\u00eb Amsterdamit ( 02 Tetor 1997 )dhe faktit q\u00eb BE kishte nisur negociatat e po p\u00ebrgatitej t\u00eb an\u00ebtar\u00ebsonte 10 vende t\u00eb Europ\u00ebs Q\u00ebndrore e Lindore.<\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb nj\u00eb zhvillim dometh\u00ebm\u00ebs ishte Politika e Fqinj\u00ebsis\u00eb e BE (European Neighourhood Policy \u2013 ENP) q\u00eb u krijua n\u00eb vitin 2004 p\u00ebr shkak se nga an\u00ebtar\u00ebsimi i menj\u00ebhersh\u00ebm i 12 vendeve kandidate , ku 10 ishin vende t\u00eb EQL dhe 2 vende i p\u00ebrkisin Mesdheut Jugor, kufijt\u00eb e jasht\u00ebm t\u00eb BE u zgjeruan duksh\u00ebm me vende t\u00eb tilla si Armenia, Ukraina, Bjellorusia, apo Libia, Egjipti etj. Me k\u00ebt\u00eb politik\u00eb tashm\u00eb do t\u00eb merrej Komisioneri Europian p\u00ebr Marr\u00ebdh\u00ebniet me Jasht\u00eb ( EU Commissioner for External Relations). Por s\u00ebrish k\u00ebto zhvillime u pasuan me ndryshime t\u00eb m\u00ebtejshme teksa pas hyrjes n\u00eb fuqi t\u00eb Traktatit t\u00eb Lisbon\u00ebs( TFEU) m\u00eb 01 Dhjetor 2009 portfofoli i Komisionerit Europian p\u00ebr Marr\u00ebdh\u00ebniet me Jasht\u00eb ( EU u shkri me at\u00eb t\u00eb P\u00ebrfaq\u00ebsuesit t\u00eb Lart\u00eb t\u00eb BE p\u00ebr Pun\u00ebt e Jashtme dhe Politik\u00ebn e Siguris\u00eb (High Representative of the Union for Foreign Affairs and Security Policy).<\/p>\n\n\n\n<p>Si rrjedhoj\u00eb pas k\u00ebtij ndryshimi Politika e Fqinj\u00ebsis\u00eb ( ENP) e BE u menaxhua deri n\u00eb vitin 2014 nga Komisioneri i BE p\u00ebr Tregtin\u00eb( EU Trade Commissioner) kur m\u00eb pas kaloi si fush\u00eb p\u00ebrgjegj\u00ebsie e Komisionerit t\u00eb BE p\u00ebr Politik\u00ebn e Zgjerimit dhe t\u00eb Fqinj\u00ebsis\u00eb ( EU Commissioner for Enlargement and Neighbourhood Policy) duke e shkrir\u00eb politik\u00ebn e zgjerimit dhe at\u00eb t\u00eb fqinj\u00ebsis\u00eb s\u00eb BE n\u00eb nj\u00eb post t\u00eb vet\u00ebm. Nj\u00eb nga pasqyrimet e k\u00ebtij ndryshime institucional n\u00eb raport me procesin e zgjerimit t\u00eb BE, \u00ebsht\u00eb &#8220;Paketa e Zgjerimit&#8221; ( Enlargement Package ) q\u00eb Komisioni Europian miraton cdo vit , ku p\u00ebrfshihet nj\u00eb komunikat\u00eb p\u00ebr procesin e zgjerimit drejt BE q\u00eb p\u00ebrcakton hapat q\u00eb duhet t\u00eb ndjek\u00eb cdo vend kandidat dhe progress raportet e cdo vendi.<\/p>\n\n\n\n<p>Gjithsesi \u201c vala apo dekada e kat\u00ebrt\u201d zgjerimit q\u00eb p\u00ebrfshiu procesin e an\u00ebtar\u00ebsimit t\u00eb formatit \u201cBing Bang\u201d me vendet e Europ\u00ebs Q\u00ebndrore e Lindore kishte nj\u00eb mesatare t\u00eb koh\u00ebzgjatjes t\u00eb negociatave nga 3 deri n\u00eb5 vjet. Kjo n\u00ebnkuptonte se d\u00ebshira dhe entuziazmi i vendeve an\u00ebtare t\u00eb BE p\u00ebr tu zgjeruar n\u00eb ish- Lindjen komuniste e kishin mundur deri diku \u201c logjik\u00ebn e ftoht\u00eb dhe mekaniciste t\u00eb negociatave\u201d. Por nga ana tjer\u00ebr kur vala e zgjerimit , iu afrua rajonit t\u00eb Europ\u00ebs Juglindore apo Ballkanit Per\u00ebndimor, duket se u pati nj\u00eb stepje, qoft\u00eb para termit q\u00eb \u201c k\u00ebto vende duhet t\u00eb stabilizohen e m\u00eb pas t\u00eb asociohen\u201d, por edhe ndoshta se \u201ckapaciteti p\u00ebrthith\u00ebs\u201d i BE kishte filluar t\u00eb shfaqte probleme. Termat si \u201c lodhje nga zgjerimi\u201d filluan t\u00eb shfaqen n\u00eb horizont dhe p\u00ebrvec Kroacis\u00eb q\u00eb ia doli pas 7 vjet negociatash ta kap\u00ebrcente tunelin e gjat\u00eb t\u00eb an\u00ebtar\u00ebsimit n\u00eb BE , 6 vendet e tjera t\u00eb Ballkanit ( Serbia., Mali i Zi, Maqedonia, Shqip\u00ebria, Kosova e Bosnja Hercegoniac ) q\u00eb prej 5 Shkurt t\u00eb 2020 po p\u00ebrballen me nj\u00eb metodologji t\u00eb re zgjerimit p\u00ebr n\u00eb BE .<\/p>\n\n\n\n<p>Serbia dhe Mali i Zi si dy nga vendet e \u00cbB6 q\u00eb kan\u00eb nisur negociatat me BE, filluan t\u00eb ndjejn\u00eb pesh\u00ebn se politika e metodologjia e zgjerimit p\u00ebr Ballkanin tashm\u00eb kishte ndryshuar, Kjo u v\u00ebrejt q\u00eb me Kroacin\u00eb ku u p\u00ebrckatua \u201cParimi i Regat\u00ebs-(termi n\u00eb anglisht \u201cRegata approach) n\u00ebnkupton-kush mb\u00ebrrin i pari.<\/p>\n\n\n\n<p>Mali i Zi tashm\u00eb ka hyr\u00eb n\u00eb vitin e 10-t\u00eb t\u00eb negociatave pasi i filloi ato m\u00eb 29 Qershor 2012 duke hapur 30 kapituj t\u00eb acquis dhe duke mbyllur 6 prej tyre. Nd\u00ebrkoh\u00eb Serbia ka hyr\u00eb n\u00eb vitin e 8 -t\u00eb t\u00eb k\u00ebtyre negociatave teksa i fillioi ato m\u00eb 21 Janar 2014 duke arritur t\u00eb hap\u00eb deri tani 18 kapituj e duke mbyllur vet\u00ebm 2 prej tyre<\/p>\n\n\n\n<p>.Q\u00eb prej vitit t\u00eb kaluar t\u00eb dy vendet jan\u00eb b\u00ebr\u00eb pjes\u00eb e metodologjis\u00eb s\u00eb re t\u00eb zgjerimit t\u00eb BE dhe koh\u00ebzgjatja e tyre e deritanshme e negociatave e ka kap\u00ebrcyer dyfshin e koh\u00ebzgjatjes mesatare t\u00eb negociatave me t\u00eb cilat u p\u00ebrball\u00ebn vendet e Europ\u00ebs Q\u00ebndrore e Lindore,. N\u00ebse b\u00ebjm\u00eb nj\u00eb vler\u00ebsim t\u00eb p\u00ebrmbledhur t\u00eb metodologjis\u00eb s\u00eb re t\u00eb zgjerimit q\u00eb BE miratoi m\u00eb 25 Mars 2020, ajo \u00ebsht\u00eb e mb\u00ebshtetur n\u00eb kat\u00ebr parime themelore q\u00eb duhet t\u00eb ken\u00eb negociatat e BE me vendet kandidate 1)besueshm\u00ebri, 2)drejtim m\u00eb t\u00eb fort\u00eb politik, 3) dinamik\u00eb dhe 4) parashikueshm\u00ebri.<\/p>\n\n\n\n<p>N\u00eb pamje t\u00eb par\u00eb duket sikur k\u00ebto element\u00eb kan\u00eb munguar n\u00eb negociatatat e m\u00ebparshme me vendet kandidate , por n\u00eb fakt jan\u00eb reflektim i nj\u00eb prirje p\u00ebr ti theksuar m\u00eb shum\u00eb k\u00ebto parime. Pra, n\u00ebse analizojm\u00eb ndarjen e parimeve sipas metodologjis\u00eb s\u00eb re, rezulton t\u00eb jet\u00eb nj\u00eb m\u00ebnyr\u00eb p\u00ebr t\u00eb kontrolluar nj\u00eb proces q\u00eb nuk duhet t\u00eb b\u00ebhet \u201cmekanicist\u201d p\u00ebrball\u00eb negociatave teknike t\u00eb vendit kandidat me Komisionin Europian. Qasja e re ka marr\u00eb nj\u00eb r\u00ebnd\u00ebsi t\u00eb vecant\u00eb kur aspektet themelore t\u00eb funksionimit t\u00eb demokracis\u00eb s\u00eb nj\u00eb vendi kandidati mund t\u00eb \u201cerr\u00ebsohen\u201d nga \u201cmali me ligje t\u00eb acquis\u201d t\u00eb miratuar, q\u00eb ky vend vendos si sukses n\u00eb tavolin\u00ebn e negociatave. P\u00ebr k\u00ebt\u00eb arsye ndryshe nga metodologjia e deritanishme , metodologjia e re i rigrupon t\u00eb 35 kapitujt e acquis communitare n\u00eb 6 grupe tematike (termi n\u00eb anglisht clusters) .<\/p>\n\n\n\n<p>N\u00eb baz\u00eb t\u00eb k\u00ebtij parimi t\u00eb ri metodologjik p\u00ebr negocitatat e vendit kandidat me BE , plot\u00ebsimi i detyrimeve p\u00ebr kapitujt q\u00eb p\u00ebrmban nj\u00ebri grup, i hap rrug\u00ebn \u00e7eljes s\u00eb kapitujve t\u00eb grupit t\u00eb radh\u00ebs. N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb ndiqet nj\u00eb logjik\u00eb e nj\u00ebpasnj\u00ebshme dhe jo paralele sic parashikonte metodologjia e m\u00ebparshme ku disa kapituj mund t\u00eb hapeshin nj\u00ebkoh\u00ebsisht. N\u00eb k\u00ebt\u00eb kuad\u00ebr Grupi i I-r\u00eb( Cluster) :Themeloret, p\u00ebrfshin plot\u00ebsimin e kushteve t\u00eb kriterit ekonomik, t\u00eb funksionimit t\u00eb institucioneve demokratike dhe t\u00eb reform\u00ebs n\u00eb administrat\u00ebn publike si pjes\u00eb e Kritereve t\u00eb Kopenhagenit( 1993) dhe Madridit (1995) si edhe plot\u00ebsimin e acquis p\u00ebrmes rezultateve n\u00eb Kapitullin 23: Gjyq\u00ebsori dhe t\u00eb drejtat themelore, Kapitulli 24: Drejt\u00ebsia, liria dhe siguria, Kapitulli 5: Prokurimi publik, Kapitulli 18: Statistikat, Kapitulli 32: Kontrolli financiar.<\/p>\n\n\n\n<p>Metodologjia e re e zgjerimit e konsideron k\u00ebt\u00eb grup si \u201cthemelin\u201d e negociatave pasi ai do t\u00eb hapet i pari dhe do t\u00eb mbyllet i fundit, ku p\u00ebrfshihen \u00e7\u00ebshtjet e gjyq\u00ebsorit dhe funksionimit t\u00eb d\u00ebmokracis\u00eb. N\u00eb k\u00ebt\u00eb kuptim \u00ebsht\u00eb e qart\u00eb dhe e dukshme se metodologjia e re e zgjerimit e ve theksin tek p\u00ebrmir\u00ebsimi dhe funksionimi i demokracis\u00eb dhe shtetit t\u00eb s\u00eb drejt\u00ebs, duke i konsideruar si parakushte themelore p\u00ebr hapjen e kapitujve lidhur me aspektet ekonomike dhe standartet teknike t\u00eb fushave t\u00eb caktuara. N\u00ebse p\u00ebrdorim nj\u00eb term t\u00eb thjesht\u00eb kjo n\u00eb vetvete pasqyron nj\u00eb \u201crizgjim\u201d t\u00eb v\u00ebmendjes t\u00eb BE p\u00ebr t\u00eb rind\u00ebtuar nj\u00eb \u201cproces m\u00eb t\u00eb zgjuar\u201d q\u00eb sipas tyre \u00ebsht\u00eb n\u00eb gjendje t\u00eb dalloj\u00eb \u201cfasad\u00ebn\u201d nga realiteti i funksionimit t\u00eb demokracis\u00eb e shtetilt ligjor. Megjith\u00ebse si\u00e7 kan\u00eb provuar rastet e fundit n\u00eb Hungari e Poloni \u201cvaksina e an\u00ebtar\u00ebsimit\u201d nuk t\u00eb mbron nga viruset q\u00eb qarkullojn\u00eb n\u00eb mjedisin politik. Nd\u00ebrkoh\u00eb logjika e nd\u00ebrlidhur tematike dhe sektoriale n\u00eb metodologjin\u00eb e re t\u00eb zgjerimit ka b\u00ebr\u00eb t\u00eb mundur q\u00eb kapitujt e mbetur t\u00eb Acquis t\u00eb p\u00ebrfshihen n\u00eb grupet e tjera (cluster).<\/p>\n\n\n\n<p>Megjithat\u00eb pesha politike q\u00eb marrin vendet an\u00ebtare t\u00eb BE brenda k\u00ebsaj metodologjie rrezikon ta zgjas\u00eb at\u00eb n\u00eb kurriz t\u00eb vendeve kandidate. Parashikimet e shpejtuara mund t\u00eb jen\u00eb t\u00eb rrezikshme kur analizon, por ka element\u00eb q\u00eb e ringjallin k\u00ebt\u00eb \u201cfrik\u00eb\u201d t\u00eb parakohshme. Me k\u00ebt\u00eb metodologji, shtetet an\u00ebtare t\u00eb Bashkimit Evropian do t\u00eb ken\u00eb m\u00eb shum\u00eb fuqi p\u00ebr t\u00eb nxitur pezullimin e negociatave t\u00eb anetar\u00ebsimit n\u00eb vart\u00ebsi t\u00eb vler\u00ebsimit q\u00eb ata b\u00ebjn\u00eb nd\u00ebrsa i t\u00ebr\u00eb procesi i negociatave edhe mund t\u00eb pezullohet n\u00ebse vler\u00ebsohet se nuk ka pasur p\u00ebrparim apo kur ndonj\u00eb shtet kandidat b\u00ebn hapa prapa.
